La desviación puede llegar tan pronto como el contacto inicial con un agente de la ley. Esta discrecionalidad que utiliza el oficial podría considerarse un desvío, ya que el oficial está diciendo que este individuo no necesita continuar en el camino de la justicia. Podría ser una advertencia verbal, o una multa de advertencia, o simplemente una decisión del oficial de no iniciar una multa formal (citación).
